Terms of Service

These terms are an agreement between you and [to be confirmed by counsel], of [to be confirmed by counsel] ("Cardiki", "we", "us") about your use of the Cardiki apps for iOS and Android, the website at cardiki.com, and everything they offer (together, the "Service"). Please read them. If you have a question, write to support@cardiki.com.

1. Acceptance and eligibility

By creating an account, drawing a card, or otherwise using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Service.

You must be at least 16 years old to use Cardiki. We ask for your date of birth before your first reading and keep only your birth year and an age bracket. If you are under 16 we will not create an account for you and we do not keep the date you entered. If we learn that an account belongs to someone under 16, we close it and delete its data. We never knowingly collect information from children under 13; if we receive a credible signal that someone under 13 has used the Service, we suspend the account and delete it within 72 hours.

2. Nature of the Service

Cardiki provides tarot and oracle card imagery, AI-generated interpretations, and journaling tools for entertainment and personal reflection only. Nothing in the Service is a prediction, a statement of fact about future events, or professional advice of any kind, including medical, psychological, legal, financial, or safety advice. Interpretations are produced by an automated system without human review. You are solely responsible for decisions you make. If you need help, contact a qualified professional or the emergency and support services listed in the app.

Every reading carries the line "For reflection and entertainment only. Not a prediction, not advice." Our public safety protocol explains how we handle questions about health, money, the law, other people and crisis situations.

3. Your account

You can start using Cardiki without giving us your email address; we create an anonymous account tied to your device. You can later link that account to an email address, Sign in with Apple, or Google so you can use it on other devices and recover it.

You are responsible for keeping access to your sign-in methods secure. Tell us at support@cardiki.com if you think someone else has accessed your account. One account is for one person; please do not share it.

4. AI-generated content and its limits

Interpretations, daily messages, the collective card message and weekly recap summaries are written by an AI model from the cards you drew, the spread, your question, your stated focus and, only if you have turned on "Personalise with my journal", recent mood tags and journal text. Each interpretation is labelled "Written by AI from your cards and question". No person reads your question or writes your reading. If you ask the app whether you are talking to a person, it will tell you that you are not.

AI output can be wrong, generic, or not fit your situation. Cardiki is designed never to answer questions about future events with a yes, a no, a date or a probability, and never to give medical, legal, financial or betting guidance. If a reading seems inaccurate, harmful, predictive or offensive, use "Report this reading" and we will review it. We may decline to interpret a question, or offer support resources instead of a reading, as described in our safety protocol.

5. Cardiki Plus

Cardiki is free to use. Cardiki Plus is an optional subscription that adds longer, journal-aware interpretations, unlimited questions, pattern insights, advanced spreads and premium deck art. The features included in Plus are described on the Plus page and may change over time; we will not remove a core feature you have paid for during a billing period you have already paid.

Price and renewal. Before you buy, the checkout screen shows the price, the billing interval, any free trial and its end date, the date and amount of your first charge, and that the subscription renews automatically until you cancel. You must tick an unticked box to agree to these terms. We keep a record of what you agreed to and when. Your subscription renews at the end of each period at the then-current price until you cancel.

Free trials. If your plan includes a free trial, you will not be charged until it ends. We email you at least three days before a trial on the web ends. If you cancel before the trial ends, you will not be charged.

Reminders and price changes. For annual plans bought on the web, we email you 15 to 45 days before each renewal. We tell you at least 30 days before any price change takes effect, with the new price and a link to cancel. A price change never applies to a period you have already paid for.

Cancelling. On the web you can cancel in Settings in two taps, with at most one screen asking whether you are sure. You never need to call us. We confirm the cancellation by email. You keep Plus until the end of the period you have paid for.

Purchases through Apple or Google. If you subscribe in the iOS or Android app, Apple or Google handles billing, reminders, cancellation and refunds under their own terms. The app links you to the right place to manage the subscription. A Plus subscription bought on any platform works on every platform when you are signed in to the same account.

Refunds. If you are in the United States and this is your first Plus purchase on the web, you may ask for a full refund within 14 days, no questions asked. Outside that, payments are not refundable except where the law requires.

Right of withdrawal (EU and UK). If you live in the European Union or the United Kingdom, you may withdraw from a web subscription within 14 days of buying it without giving a reason, using the "Withdraw from contract" option in Settings or by writing to support@cardiki.com. Because Plus starts immediately, we ask you at checkout to agree to immediate performance and to acknowledge that this affects your withdrawal right. Even so, if you withdraw within 14 days we refund the unused part of your payment on request. UK residents also have a cooling-off period after each renewal where UK law provides one.

6. Acceptable use

Please use Cardiki the way it is meant to be used: for your own reflection. You agree not to:

  • break the law or help anyone else break it while using the Service;
  • harass, threaten or harm anyone, or use the Service to try to watch, track or find another person;
  • submit sexual content involving minors, or content that promotes violence or hatred against people;
  • try to get the AI to produce harmful content, or to work around its safety rules;
  • copy, scrape, resell or bulk-download the Service or its content, or use it to build a competing product;
  • interfere with the Service's security or operation, probe it for vulnerabilities outside a coordinated disclosure, or access accounts that are not yours;
  • create accounts automatically or in bulk, or abuse free limits, referral rewards or trials.

7. Your content

Your questions, journal entries, mood tags and reflections belong to you. Your journal is private: we do not show it to other users, and we only share a reading or a line from your journal when you choose to share it.

You give us a limited licence to store, process and display your content only as needed to operate the Service for you, for example to generate a reading, sync your journal across devices, or create a share image you asked for. This licence ends when you delete the content or your account, except for copies we must keep by law or that remain for a short time in backups.

We never use your content to train or fine-tune any AI model, and we do not allow our AI provider to do so.

You can export everything in Settings, and you can delete individual entries or your whole account at any time. See Delete your account.

8. Our content and intellectual property

The Cardiki name, logo, app designs, written card meanings, prompts and software belong to Cardiki and are protected by law. You may share readings and share images through the features we provide. Otherwise, please do not copy or reuse our content without permission.

The card art in the default deck is The 1909 Deck, illustrated by Pamela Colman Smith and first published in December 1909. That artwork is in the public domain; our scans come from original early printings. Premium decks may contain artwork licensed to us, which you may view in the app but not extract or reuse.

9. Third-party readers

We may later offer readings by independent human readers. If we do, those readings will be covered by separate terms that you will see before booking. Nothing in the current Service involves a human reader.

10. Disclaimers and limits of liability [to be confirmed by counsel]

The Service is provided "as is" and "as available". To the extent the law allows, we make no promises that the Service will be uninterrupted or error-free, or that any reading will be accurate, useful or suited to your circumstances.

To the extent the law allows, Cardiki is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 50 US dollars.

If you are a consumer in the EU or UK: nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects your statutory rights, including your rights when digital content or services are faulty. We are responsible for foreseeable loss caused by our breach of these terms or our failure to use reasonable care and skill.

11. Indemnity

If you are using the Service other than as a consumer, you agree to compensate us for reasonable costs and losses arising from a claim by a third party caused by your breach of these terms or your misuse of the Service. This section does not apply to consumers in the EU or UK.

12. Disputes [to be confirmed by counsel]

Please contact support@cardiki.com first; most problems can be solved quickly that way.

If you live in the United States: any dispute that we cannot resolve informally will be settled by binding individual arbitration under consumer arbitration rules, rather than in court, except that either of us may bring an individual claim in small claims court. You and Cardiki each waive the right to a jury trial and to take part in a class action or class arbitration. You may opt out of this arbitration agreement by emailing support@cardiki.com within 30 days of first accepting these terms, with your name and the words "arbitration opt-out"; opting out does not affect any other part of these terms.

If you live in the EU or UK: you may bring proceedings in the courts of the country where you live, and you keep the protection of the mandatory consumer laws of that country. The European Commission's online dispute resolution information is available at https://consumer-redress.ec.europa.eu.

13. Ending your use of the Service

You may stop using Cardiki and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, that puts other people at risk, or where the law requires it. Where reasonable, we will tell you why and give you a chance to export your data first. If we close the Service entirely, we will give you at least 30 days' notice and a pro-rata refund of any prepaid Plus period bought on the web.

14. Changes to these terms

We may update these terms as the Service changes. For material changes we will tell you in the app or by email at least 30 days before they take effect. If you keep using the Service after that, the new terms apply; if you do not agree, you can cancel and delete your account before they take effect.

15. Governing law

If you live in the EU or UK, these terms are governed by the law of the country where you live, and you keep the protection of its mandatory consumer laws. Anywhere else, these terms are governed by [to be confirmed by counsel], without regard to conflict of laws rules.

Apple App Store users

If you downloaded Cardiki from the Apple App Store, these terms are between you and Cardiki, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Cardiki, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims and intellectual property infringement claims. You confirm that you are not located in a country subject to a US government embargo or on any US government list of prohibited or restricted parties. You must comply with any applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
